Please read these Terms & Conditions carefully before using the GradeX mobile application. By installing or using GradeX, you agree to be bound by these terms. If you do not agree, do not use the app.

1. Acceptance of Terms

By downloading, installing, or using GradeX ("the App"), you agree to comply with and be bound by these Terms & Conditions and our Privacy Policy. These terms apply to all users of the App.

2. App Description

GradeX is an outdoor activity companion app providing:

Real-time GPS navigation and gradient/slope display
Activity recording (motorcycling, cycling, hiking, running, walking, driving)
Offline map viewing powered by OpenStreetMap
Elevation profiling using NASA SRTM data
Weather information along routes
Group ride coordination and mesh intercom
Heart rate monitoring via Bluetooth sensors

3. Data Accuracy Disclaimer

Important — Please Read Carefully.

GradeX displays data derived from GPS sensors, satellite imagery, third-party databases, and on-device calculations. This data is provided for general informational and recreational purposes only. The App is NOT a substitute for professional navigation equipment, certified survey instruments, or official safety guidance.

The developers of GradeX make no representations or warranties — express or implied — regarding the accuracy, completeness, reliability, suitability, or availability of any data displayed in the App, including but not limited to:

GPS position, speed, altitude, and bearing
Road gradient and slope angle readings
Elevation profiles and terrain data (sourced from NASA SRTM)
Map data and road information (sourced from OpenStreetMap)
Weather forecasts and conditions (sourced from Open-Meteo)
Heart rate readings from connected BLE sensors
Calculated statistics (distance, climb, calorie estimates)

Displayed values may be inaccurate due to GPS signal degradation, poor satellite geometry, device hardware limitations, mapping errors, sensor calibration issues, atmospheric conditions, or errors in third-party data sources.

GradeX and its developers are NOT responsible or liable for any inaccuracies, errors, or omissions in the data displayed in the App, or for any loss, damage, injury, or harm resulting from reliance on such data.

4. Limitation of Liability

To the maximum extent permitted by applicable law:

The App is provided "AS IS" and "AS AVAILABLE" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
GradeX and its developers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind arising from or in connection with your use of the App, including but not limited to: personal injury, property damage, financial loss, data loss, or any decision made in reliance on App data.
This limitation applies regardless of whether the claim is based on warranty, contract, tort, statute, or any other legal theory, and even if GradeX has been advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, the above limitation may not apply to you.

5. User Responsibilities

By using GradeX, you agree that:

You will use the App as a supplementary tool only and exercise your own judgement for all navigation, safety, and route decisions.
You will not rely solely on App data (GPS, gradient, weather, maps) for safety-critical decisions.
You are responsible for obeying all applicable traffic laws, road rules, and local regulations.
You will not use the App while operating a vehicle in a manner that violates local law or endangers yourself or others.
You are solely responsible for your physical fitness, equipment condition, and suitability for any activity you undertake.
You will not use the App for any unlawful purpose.

6. Third-Party Services

The App integrates with third-party services whose accuracy and availability are outside our control:

OpenStreetMap — community-maintained map data; may contain errors or be out of date.
NASA SRTM — satellite elevation data; accuracy varies by region.
Open-Meteo — weather forecast data; forecasts are estimates and not guaranteed.
Google AdMob & Firebase — advertising and analytics; governed by Google's Terms of Service.
Google Nearby Connections — peer-to-peer mesh networking for Group Ride; governed by Google's Terms of Service.

GradeX is not responsible for the content, accuracy, or availability of any third-party service.

7. Intellectual Property

The GradeX app, its design, code, and original content are the property of the GradeX developers. Map data is © OpenStreetMap contributors (ODbL). Elevation data is from NASA SRTM (public domain). All third-party trademarks and logos belong to their respective owners.

You may not copy, modify, distribute, sell, or lease any part of the App without written permission from the GradeX developers.

8. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms & Conditions at any time. The updated version will be indicated by the "Last updated" date at the top. Continued use of the App after changes constitutes acceptance of the revised terms.

9. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is based, without regard to conflict of law provisions.
